Recreational bikers join court challenge

THE nation's peak recreational motorcycle group will consider backing a High Court challenge by outlaw bikie gangs to new Queensland laws.

Criminal lawyer Peter Shields acts for members of gangs that have been deemed criminal organisations in the Queensland crackdown.

Mr Shields says he'll mount a High Court challenge against the laws as soon as possible.

The Australian Motorcycle Council is launching a fighting fund to raise money for court action expected by some of the 26 bikie gangs that are now declared criminal organisations.

"We have no doubt these laws will end up being challenged in the High Court," council chairman Shaun Lennard told AAP.

"Our executive will consider any request for financial support.

"It's not an open cheque book but I would not be surprised if a challenge comes from a member of one of the 26 organisations who may not have any criminal convictions."

He says the laws are too broad and innocent recreational motorcyclists could be caught up in the crackdown.

Mr Shields believes the laws are unconstitutional and there's a strong prospect that a High Court challenge will be successful.

He says the laws have been so poorly crafted that there's no way for his clients to show they have severed ties with declared gangs.

"Someone from the government, who is responsible for this legislation, needs to put in writing what it is a bikie must do so they're no longer considered a bikie."

A LAWYER says he will mount a High Court challenge to Queensland's new bikie laws as soon as possible.

Peter Shields acts for unnamed members of several motorcycle gangs that have been deemed criminal organisations under the new laws.

He's told ABC radio he will mount a High Court challenge "as soon as we can".

Mr Shields also refuted any suggestion the laws were pushing bikies out of Queensland.

"Not one of my clients has left the state," he said, adding they were doing their best to comply with the new laws.

But he said the laws had been so poorly crafted that was almost impossible.

Mr Shields said they failed to spell out what bikies could do to be considered to have quit declared criminal gangs.

"What we've been doing is sending colours back to the national executive," he said.

But lawyers were dealing with an information vacuum.

"Someone from the government, who is responsible for this legislation, needs to put in writing what it is a bikie must do so they're no longer considered a bikie."

Meanwhile, the Australian Motorcycle Council will on Monday launch a national fighting fund to raise money to assist any High Court challenge.

"In short, we believe these laws are in fact partly intended as an attack on motorcycling as a pastime, despite comments to the contrary from the Queensland government," council chairman Shaun Lennard said in a statement.

"The AMC is a volunteer-run organisation with limited resources and this decision has not been taken lightly.

"However, as the peak rider organisation in the country, we have decided to establish this account in response to numerous requests for a place to donate funds."

I think it's very sad to see badass white men reduced to....sissies.

Saw a clip on YT last night about what it's like now that they've taken the guns away. Hard to believe that a country that

spawned Mel Gibson would allow the NWO to take the damn guns away and leave the people without defense against criminals.

If they try that shit in the USA they will get their civil war, for SURE.

Salter is a great man and has good things to say...I used to love that country because the men were MEN.

 

So you want Oz to be like the USA? No thanks. 

And why do you infer that a man is less without a gun?  REAL men have the guts to stand up and solve their problems, they don't need a gun.

And as for OUTLAW biker gangs, the sooner they are eradicated the better. The government has full public support for their proposal. Law abiding riders have nothing to worry about.

Only an idiot would be in support of the actions of these daylight criminals. Aussies want less crime, turning a blind eye has caused the problems. I have enjoyed a commaraderie with bikers of old, not outlaws who are only criminals who don't give a feck about you or me  - its these guys that are being discrimated against. The great bulk of Aussies fully support no guns on the streets and the control of criminals. If you or anyone else wants to be an idiot then go ahead - let them into your house.
