INCOME REQUIREMENT FOR SPOUSAL VISA?

then she says i have friend that live with a white guy they live in california and they get food coupon , and free medical for the children and help with rent and many things.. i said well if they catch the husband he will be in big trouble...,, she says the husband is not there the white guy is not the pappa of the children he is the live in and if they marry all the money dont come so they just live in... I said the pappa what happen to him....??? She said well she told me he was so stupid and she dont want to stay with him so after 5 years she left... then the kicker ... she says the reason she left the husband is he is a cheater and scam people and she dont want her children to grow up that way....
And you know, she's right. Our system is so screwed up now that they are completely within the law (unless there's a rule about having a live in being considered a marrital relationship) and there's no incentive for them to work or actually pay for the free stuff they're getting. Truly amazing.

No that form is not needed. However if you would read this section.

 

INA Sec. 212(a)(4)(b They are required to prove they can support themselves and will not become an a burden on society. Do they need a piece of paper no everyone is right. They must though prove they can support themselves.

 

I have read this law and almost all the laws on immigrant visas at least twice the burden for her is greater. Without guidelines and generic statements it is left up for interviewer. Just like a visitors visa.

Well if you die she does not have to meet any income requirements figure that she gets a pass!!!

The income thing is curious for those living outside the US since they can make much more once they get here. I can understand it if the man is in the states and bringing someone in.

 

As for the illegals had the 20 million of them started protesting and creating reform in their homeland maybe they could have fixed their socialist craptastic system instead of coming here where they then vote for democrats to help bring us down to 3rd world craptastic socialism over time.

 

If they bothered to learn our language and strive to be citizens rather than demanding we make America like their homeland and leech hundreds of billions of tax dollars, they might get more sympathy from me.

Also my wife would make it any way as she gets 75%of my SS check for my child and after a few months in the USA she will get a check also. so more than enough other prove if they did want some.

 

I would advise you to read the law. Your child's check does not count for her support. Hence the check is for the child. She would have a very difficult time proving she can support herself. Additionally she only has 2 years from your death to submit.

Well, that is interesting. I was told by the consulate that she would have one year to submit. Are you sure it's two years?

Yes it was a change to the recent law. She has two years. They have child so there are other options besides the widows visa.

Yes, it is two years from the date of your demise she has to file for a widows visa, and has been for quite some time. The recent changes revolved mostly around the amount of time you were married before your demise. Used to be you had to be married for two years, that part has been dropped. So she can now marry you one week, demise you the second week, and file for a widows visa on the third week!

We currently have a client (widow) in this very position who will be going to interview in the upcoming months, I will post the results when they are in. I look for a positive outcome for her.

wow that change if it gets out will mean a few more foreigners going to the pearly gates early.... lets see find a fool marry him on monday , knock him off on tues .. apply for your visa and collect his SS and VA if he has any.... bad news now the guy is worth a lot more gone

so what your saying is ..... if i collect SS every girl i get PG gets a check ? so the first one gets 50% then another so the check is split ? or does each one get 50% .... wow that is amazing so my new line can be .... Hey sexy lets me and you make a baby and then you can get paid every month for 18 years???

Well...that could make for a nasty surprise for her. If she knocks him off before he puts her on as a beneficiary on his retirement (which requires a certified marriage certificate), then she gets nothing from his pension. If she isn't yet 60 and hasn't already lived in the US, she won't get his SS either. SS can only be immediately passed on to his natural-born child (provided the child is under 18). She could lose big time on that deal unless he has a big bank account and investment portfolio and he has already put her down as beneficiary. How likely is that?

The amount would be split between children, but if the mother isn't your wife, then there would have to be a DNA test...and of course in the process, your wife will have you killed because of the adultery. You might want to rethink that plan.
