If you can go down there with Cash in hand be humble and pay. Have a ticket to exit the country also. I would think you will not be blacklisted. The key is being humble dressed well and have the ex

I see you have left yourself two choices...........one, go to BI with a good story, a somber face, about 200,000 peso's, an exit ticket and take your chances. Two, have an exit ticket, go to the airport and and find a sympathetic BI officer that may let you leave at a fraction of the cost. Either way you got a 50/50 chance of getting out. Good Luck, got to be a lesson in here somewhere.

If you have an exit ticket and money in hand. I doubt they will jail you. You are wanting to pay. I really really doubt it.

This is not true. They can, and probably will, detain you if you owe back monies. Do not do this! Contact Paul Whiteway at www.cebuexpatservices.com

He has a lawyer who should be able to assist you.

Incidentally, back in January 2006, I was an overstaying alien. I had to pay all of my past due fees prior to being released. In your case, do make sure that you are given actual certified receipts for your payments. An honest agent will certainly make sure that you do. And, just because you are an overstaying alien does NOT mean you will be black listed.

Do you know what the fees would be? I don't know how much money to bring. If I dont have enough money it may take days before I can withdraw the extra money to pay the rest.

I don't understand the BOI website and what fees would apply.

The Alien Control Officer, at the branch where you go, will be able to calculate, from your last legal extension, how much you owe.

Where is your local embassy, how soon can you get there (BTW, Hope you are not American...they may not offer much help)

If it is the American Embassy in Manila, don't even bother. You are much better off with people who can refer you to the right sources.

I read a story recently of a japanese woman who overstayed. She was kidnapped by head NBI officials and held until she paid 6M pesos. I'm scared of being kidnapped, or killed, or something for the money by the BI officials.

This is not going to happen. Just go to the right Alien Control Officer.

There again, this ENTIRELY depends on if he goes to the right BOI location, AND if he communicates with the RIGHT person there..

I think the truth would be a much better thing to go with, in any case.

Not to mention, I would never, ever suggest doing something like that, because it could come back to bite them, as well as me, on the ass.

I think you have the information that you need. Also you should know this forum is watched. So stop saying anything. We know that you are scared anyone would be. But the bottom line is you have to go to BOI ASAP and paying your back fees. I would only add be prepared to bite your tongue and say alot of yes sirs and yes maiams and do not try your luck with any of the fixers. If you get caught on that account you really will be up the creek. Goodluck.

This is not true.

What is not true. If you show up with all the fees and all the money you owe. Additionally having an exit ticket to leave the country. What is not true about that. You will not go to jail. You may be detained till your plane or ship leaves. Paul with expat services does not have experience in this area.

You should just go to BI. You should have at least 33,000 for each year you overstay. You should have an onward ticket. You should be neatly dressed and should be very humble. You should be honest and just tell them the story. Chances are you are not going to be detained or go to jail. If you do not have the money then you are going to end up in Jail. So better have a plan to get more if you do not have enough.

You are correct, IF he goes to the proper people, someone who is not corrupt.

I never said Paul did. I said he has a lawyer, with whom he can connect this guy, and who may be able to sort it out for him.

I still suggest contacting Paul. Because, while Paul (himself) may not have ever had this issue come up to deal with, I can assure you, I did.

I also agree with the others, regarding not putting too much information on the internet. Of course, you have not revealed who you are, nor have you given your country of origin. I would continue to keep both to msyself.

Contact Paul. You can trust him. I have dealt with his lawyer before as well, and will do so again soon, regarding a case I will be filiing against someone. He's a good guy, and honest.

i dont think the airport will let you go through... they are real strict about stopping you leaving and telling you to go to immigration if its more than one day overstay.... also i would take the money as a cheque made payable to immigration since i would worry that the temptation for someone just to take the cash would be too much to resist. But i would also take some extra cash just in case.

i would think as BI has a web site you should go on the site and ask the commisioner himself i know the people in maudaue are honest especially upstairs , its possible that if you hire an attorney it will only put what could be a peaceful and gentle way out to a battle of lawyers... BI commisioners are most often lawyes themselves ,, how humble are you if you hire a lawyer to most it seems like your ready for battle.. //// my wife just told me for you to go there in maudaue and ask to speak to the head he is upstairs,,, she says he is a very honest person and just tell them you made a big mistake and your sorry and want to fix this problem ,, she said she did not think bringing a lawyer would be a good thing and could make then feel like you were ready to do battle in court instead of just a humble guy ready to do the right thing

I like the check idea. But again, get your money together, I would follow Smokey's advice of going to the office and asking for the head man, tell him your situation, do a lot of yes sirs and mean it. Pay the fine. Get a receipt. Go home and try not to overstay again. Good luck.

Knew one person that went through this process but that was a few years ago so maybe not the same today . This particular individual went through the American Embassy and was told he had two choices . Pay all back fees and fines and remain in the country or leave the country voluntarily in which case he would be blacklisted . Due to a lack of funds he chose to leave voluntarily .

Be advised , however , that it took over a year for his case to be processed by Filipino Immigration which put an even greater burden on him to just survive for that year . Contacting the embassy and letting them start the deportation process just kept him out of jail until his actual deportation .

i really dont think he is facing any real problem with his freedom my wife would gladly go with him if she was there and told me the commisioner will understand if your humble and willing to fix the problem ... if your really scared and there is no reason to be she knows of some people who you could ask to be your escort but its really not needed .. just be humble and admit what you did was stupid but not done to hide ..
