...Seems to me that Gwens brother acted totally correctly up until he waved the gun.

The way I read the story was that he requested and was officially granted the barriers, putting the law on his side.

He (gov's bro) did not act totally correctly because he was carrying a firearm illegally. I doubt he would always just carry an assault rifle in the back of the pickup... then again who knows?... so I'm guessing he approached the newcomer with intent to assert his authority whatever it took... behaving in exactly the same manner as racist bigoted redneck do in Oz towards immigrants... contrary to popular belief :biggrin_01: I support immigrants right up until they engage in criminal acts, or habitually vilify the native-born population.

Its no longer was he right or wrong about putting up the signs. Its a matter of if hes going to live or die. That Filipino has connections in high places and is use to getting his own way. He will not let the foreigner push him around with out some retaliation. Just hope its not severe.

well if he was in england and pulled out a gun like that ,he will be going to jail for 10 years no ifs or butts .and your right james he now has to worry about scooters passin him every minute of the day .Is it really worth it ,Id think twice before I would file a case against any fillipino driving a blacked out 4 x 4 thats fore sure .

He might be somebody back wherever he comes from but here he is definitely nobody !! Do I like that ? not a chance in hell ! but its important to learn to accept reality. no matter what james says about never backing down from tyrants you cant stand up when you are dead - or entrapped and deported. These guys have been dealing with foreigners for as long as foreigners have been coming here- and i guarantee you that the foreigner never wins !!

Often I find your posts very negative Smokey but in this one you are dead on !!! Many of the better off filipinos laugh at us stupid old men following our dicks here so we can get raped [ financially] at every turn. And if we complain about things it is so easy to get rid of us. The BID loves to deport foreigners who a filipino accuses of stepping over the line . [ Ever wonder why its called the Bureau of Immigration and DEPORTATION ????]

 

Dont get me wrong here tho, foreigners do have certain rights in the Philippines:

1.The right to spend all your money here

2.the right to buy a house for some filipina

3.the right to get charged with a crime if you should do anything at all that that filipina objects to

4. the right to get deported and lose everything you have worked all your life for

Yeah mate... You know, all of us, under the laws of the Philippines are supposed to have ALL the same rights as a Filipino citizen EXCEPT that we may not vote, hold public office or work for a Govt body (except as a consultant). Other Laws seem to contravene the discrimination Laws etc and one to mind now is the cast in stone Law preventing any of us owning land or outright ownership of businesses... Of course, in this extremely racially predjudice country (which is also against the law) all of this is bullshit and foreigners are generally well behind the eight ball in the eyes of many officials (not all).

 

 

 

Totally agree with you James - in theory !! But who will hold his children and support them if he dies standing up against a tyrant ?? This for sure aint Kansas !! This is the wild wild west and those cattle barons dont hold kindly with sheep farmers complaining !

I'm sure Morris didn't know, at the time of the incident, who this officious, overweight, little Filipino was who was pulling down his officially sanctioned and given signs... His reaction is normal. His follow up, and now he knows who the person was, well good on him I say. Unfortunately this society is far more violent than the one I come from and instant death can come from silly little things let alone a legal case... But, I'm like this guy too, I don't back down to tyrants or threats and it's a shame to have to keep an eye out for the scumbags coming for ya, but I'd rather do that than let these mongrels lord it over you and force one to cower in the corner. And unless false evidence is presented to the Immigration, it's not easy to deport someone at all and the first comeback to someone threatening you with that is to say simply... "On what grounds?"

 

AND PLEASE REMEMBER... It is specifically forbidden in the Philippine Constitution and the Supreme Court on several rulings, both of which specifically refer to the Director of Immigration and stating, that NO arrest warrant is valid for a foreigner unless a Deportation Order is already signed and in effect from the Court. The business we see often of foreigners being arrested and jailed in the Immigration prisons is illegal but they ignore both the Constitution and several Supreme court rulings/instructions.

 

Now I have a "bee in my bonnet" and hence the following (sorry)

 

On a personal note: (and I'm not worried at all or of your comments on the following if you think I am stating an innapropriate response, and I have worked to make sure my family is ok without me)...

 

One should already know of ANY Court procedings for deportation and have been given the opportunity to defend your position. For this reason, if they turn up on my doorstep I will know the warrant or the act to take me away without one, is illegal. I will be recording the incident (and I am a thoroughly mad bastard when I get going) and informing them calmly of their illegality, with a copy of the relevant rulings (already prepared), and that they are under citizens arrest. Remember they will be in my house and before I came to see them, (my wife would have taken everyone out of the area and behind solid walls but observing as witnesses) I would have armed myself, legally, when informed they had arrived. If they resist arrest and handcuffing, with their own cuffs, I expect a gunfight to occur which I am perfectly capable of conducting against these criminals in my prescence. If it ever happens, you will read about it in the news and if I survive, I will be somewhere in the Provinces hiding from the also illegal retribution, which is a far far better thing than dying in Jail which I surely will given my medical conditions. If folks here believe this is all only bravado bullshit, think again coz those who really know me know I am very capable, without fear and will not stand for illegality against innocent people by officials and in a bullshit move against me, all the above will occur, but hopefully with me arresting, disarming and handcuffing them (the criminals) only. Around here, they usually travel in 3's, sometimes 4's, in a blacked out black SUV. I had dealings with them 3 times in preventing them taking my friend away, and as usual it was about money. They are seen going into the various subdivisions around here from time to time, but haven't been spotted in a while, maybe they're concentrating elswhere? This is the ever constant danger we all live in, corruption and danger. (and I don't need the inane comments of "why don't you leave then"... I'm alright but I'm prepared to do what I have to do against any criminal) Having said that, I will probably have no problems from criminals as above... but???

The point I made was he was NOT officially granted the barriers. The HOA are the legal entity NOT the developer. Filinvest are a big company & they know that, so the stuff about their lawyers supporting him is pure bollocks. Byron is in trouble for the gun only, the rest the law is on his side & Morris will find that out when he loses & has to foot the legal bill.

And there is the key to the whole problem; too many cattle baron want-a-bees corralling stock, thinned through naturally selection of those with tendencies towards heroism. So it seems Darwin was not totally wrong.

American father ready to sue Byron for brandishing assault rifle

 

 

The American businessman who faced off an angry brother of Gov. Gwendolyn Garcia said he would file charges against the man who brandished an AK-47 assault rifle at him in a flareup over road barriers outside the foreigner’s house in Talisay City.

Wayne Morris, 56, said he didnt’ know the armed man who “acted like a bully” was Byron Garcia, a former Capitol security consultant, until after the Sunday encounter.

“He’s bullied us and tried to be a dictator,” Morris told Cebu Daily News yesterday.

The two men argued heatedly about 8 a.m. Sunday over three metal barriers with “Slow Down” signs put up by Morris on the street where he lives.

Morris, who moved in two weeks ago, said he had the signs put up after his 2-year two-year-old daughter was almost run down by a speeding car in Corona del Mar, barangay Pooc, Talisay City.

He said the signs were delivered to him at his request by Filinvest, the subdivision developer.

Morris said he conferred with lawyers of Filinvest yesterday and filed a report with the Talisay City police.

“I feel reluctant about filing a case but Filinvest told me that they will support me,” Morris said.

Moris said he would file charges of harassment, disturbing the peace and carrying an illegal weapon.

In Byron’s account, the American insulted him when he came over to remove the road barriers, and that Morris told him he was a “nobody”.

Byron said he replied, “I am a nobody but I have this,” and pulled out an AK-47 assault rifle from his pickup to show he was not intimidated.

The governor’s brother said he was the president of the homeowners association of the subdivision, and that he was acting on the complaint of some residents about the road barrier.

Although Byron said he had papers for his rifle, the PNP Firearms Explosives Security Guards and Agencies Supervisory Section (FESAGSS) said that as a civilian, he isn't authorized to carry an AK-47 rifle.

Supt. Rex Derilo, FESAGSS chief, yesterday told reporters that the PNP doesn't issue a permit to carry for long firearms to civilians, especially a powerful assault rifle.

Exceptions to the rule are governors, judges and government officials in executive department, he said.

Derilo said Byron may have a permit to possess the weapon, but he's not authorized to bring it outside his home.

He said FESAGSS is waiting for the Talisay City police's report on the incident.

He said Byron could have his gun license revoked by his action.

I just tell what i would (and have ) done i a case like this.

 

I would have gone to the Person and try to make peace with him after the argument.

 

Tell him that one got of on the wrong foot and that its all not worth to fight and quarrel about. if possible, invite him for a beerchat. And might make a powerful new friend in the process. Eventually one can even put his roadblocks back in place.

 

Because what matters for me is harmony in the neighborhood.

 

But i assume, it is too late for the American now, so his dream of having a good live in Corona del Mar is over after just being there for 2 weeks. Undoubtedly ALL others will hang their flag into the wind of the Governors relative, so its a bit of a dilemma.

 

What Byron will say about the Gun charges ?... "that he came from a Rifle shooting range when all of the sudden the American assaulted him verbally and came closer and closer to him. He was afraid for an imminent physical attack on his life, so he pulled out the only weapon at hand he had temporary in his car, an unloaded AK47. "

Well Philinvest has got behind him on this one so he may have a chance... but a small moral victory means nothing compared to the outrage and "loss of face" a over-privileged spoilt brat bully-boy feels, and will most likely act upon. I've never been a fan of gated communities, and now it seems you're not safe even in them. A song comes to mind written in 1972 by a band called "Ayers Rock"...

 

"GET OUT TO THE COUNTRY" meaning the city is gonna kill ya... could be time for another city versus province topic.
