This is what I heard on a TV talk show in Manila last year about Immigration and visas hosted by a famous Immigration Attorney Michael Gurfinkle, http://www.gurfinkel.com/ from San Francisco, who now

No, that's not the point

If the visa subclass has provision for a sponsor, the decision may be reviewed. Do some Googling, I will check again tomorrow as it's late and I must sleep.

Q&A

Non-reviewable decisions:

Offshore decisions refusing to grant visas where there is no criterion requiring nomination or sponsorship in that subclass are not reviewable. A decision that an application is not valid is not a decision to refuse to grant a visa and so is not reviewable. Decisions rejecting nominations or sponsorships are not reviewable.

In addition, the Minister has the power to issue a conclusive certificate preventing review of a decision if the Minister believes that it would be contrary to the public interest:

  • To change the decision, because any change in the decision would prejudice the security, defence or international relations of Australia, or
  • For the decision to be reviewed because such review would require consideration by a review officer or the Tribunal of deliberations or decisions of the Cabinet or of a committee of the Cabinet

If the visa subclass has provision for a sponsor, the decision may be reviewed.

Firstly, reviews and appeals are quite different processes.

Secondly, "provision for a sponsor" and "criterion requiring nomination or sponsorship" are two different issues. Applications for tourist visas do not require nominations or sponsorships - Americans, Brits, Singaporeans, et al can get tourist visas without sponsorship. However a Visa Officer may request such on a case-my-case basis. Visa subclasses such as 421 (sport), 423 (media and entertainment) & 424 (public lecturer) require sponsorship (whether it's an American, a Brit or a Filipino, no sponsor = no visa).

OK - from a New Zealand perspective :

NZ will only consider a full Sponsorship Application - that is the Sponsors ability to accommodate you, support you, pay for you Medical Expenses and show Bank Proof of this etc etc as detailed in the Sponsorship Documents. I could not find anyway to get my then gf, now wife - married in NZ, to NZ other than as her Sponsor. You male friend must also provide proof of having visited you in the Philippines and the level of commitment to each other is important and must be supported with photos, letters of support from family and anything else they or you can think of. The first application was rejected. The 2nd application I went to the NZ Embassy in Manila with her and ensured that all documents were correct including the "new" conditions from the last application. Even tho it was the NZ Embassy the visible staff are Philippine as is their mind set. They held up the decision until I went back to NZ (after 21 day + 59 day extension). I did not use an agent nor pay any fixer but chose to follow exactly the requirements and fulfil each of those - be aware the Embassy staff added further requirements when the intial ones were meet. Again I say without full Sponsorship the chance of a Visitor's Permit to NZ for a Philippine citizen is zero and this may also be the case for Australia.

obviously you will need to apply again but with all the information required.

thats the problem coz u dont meet each other yet pagmeet usa mo before ka mag apply ug tourist visa kay ma deny jud ka kay dili man gud na sila magdali dali ug hatag nimo if they can see that you and your bf wala pa nag meet u dont have picture of him and you together nga nagkita namo in person, then u are pure single sab wala kay anak

thats really hard too ok lang unta if u have business or properties nga ikapakita that u can return home,,,,ang sa imo nga work dili na sila magbase about sa imo nga work coz there is a possibility nga dili naka mobalik, about sa imo nga money sa bank even a few thousand still not enough evidence... u need to have the reciept also that your bf is supporting you...but in your case that is really hard i had a friend in asutralia that they same situation nimo na deny pod siya thats why nga nagkuha nalang sila ug fiancee visa....maglisod jud ka ana first wala pamo nagkita in person, wala mo mga pictures together kinahanglanon jud na importante jud na kaayo, pagkita usa mo duha, then second wala sab sila makita nga u can return home....thats why na pag apply nimo before na decline ka coz kulang ka sa mga strong evidence.....

Hi Gee, i have been through the same process as u trying to get my GF into Aussie for 3 months, have been refused 3 times it has cost me over $750.00, $105.00 per application plus other expences, we have given up trying, will wait until we r married, our Immigration r very frustrating to deal with, everytime we corrected our application they made up another excuse to refuse my GF entry, u need a minimum of $1000 per month to stay in Aussie, example is for 3 months u need $3000, i had over that amount for my GF and they still refused us on our last application.

Cheers

Mark

Hi Mark,

I have money good for 3 months but i only requested for 1 month and yet they declined.

According to an expert, they will just make up one excuse to another...you are right

but may i know if you have met ur gf before she applied the first time?

I agree. Having read the embassy letter, it changes the direction of the thread.

Gee, I suggest your BF just comes to visit you, it will save a lot of time and frustration.
