David Jr. to post bail

CEBU CITY—After spending two nights in jail, road rage shooting suspect David Lim Jr. can now go home.

This after the Cebu City Prosecutor’s Office set the bail for his temporary liberty at P144,000 for two criminal charges in relation to the shooting and wounding of nurse Ephraim Nuñal following a traffic altercation last Sunday.

Assistant Prosecutor Ma. Theresa Casiño found probable cause to charge Lim, 28 and a scion of one of the wealthiest families in Cebu, with frustrated homicide and illegal possession of ammunition at the Regional Trial Court and set the bail at P24,000 and P120,000, respectively.

Upon the advice of the counsel of the victim’s family, the police originally filed frustrated murder charges against Lim.

But Casino downgraded the case to frustrated homicide since it was not proven that there was treachery on the part of the accused in shooting Nuñal in the left thigh and right ankle.

“A judicial examination of the evidence at hand would show that there are not sufficient basis to prove the existence of any of the circumstances stated therein (murder case),” said Casiño whose resolution was approved by Cebu City Prosecutor Liceria Lofranco-Rabillas.

As of 1 p.m. on Thursday, Lim was heading to the Cebu City Hall of Justice to post bail so he could go home.

“We’re happy and thankful with the ruling. I’m optimistic that this case won’t prosper in court. But it’s not the word that doubts but the evidence behind the case,” said Lim’s lawyer Orlando Salatandre Jr.

Road rage suspect out on bail: Lim indicted to lesser case

 The Cebu City Prosecutor’s Office has  indicted  road  rage suspect David Lim Jr. to a lesser offense of frustrated homicide and illegal possession of ammunition for lack of qualifying circumstance to merit the filing of a grave offense.

Deputy city prosecutor Maria Theresa Casiño downgraded the complaint from frustrated murder after finding probable cause only for frustrated homicide. She, however, retained the illegal possession of ammunition.

“After careful perusal of all the evidence at hand, this Office finds probable cause to indict respondent for frustrated homicide,” read Casiño’s joint resolution.

She recommended P24,000 bail for frustrated homicide and P120,000 for illegal possession of ammunition.

Lim immediately posted bail for his temporary liberty after the two cases were filed in court upon the approval of city prosecutor Liceria Lofranco-Rabillas.

Lim was released from detention at 4:35 p.m. upon the orders of the two judges – Regional Trial Court Branch 5 Judge Ricky Jones Macabaya and Branch 9 Judge Alexander Acosta—where the cases were raffled off.  MORE
