You know, I was just talking about this very topic with a new guy here in Cebu, yesterday. Matt (MattinGa) happened to find this link and sent it to me while chatting on YIM, today. If a woman commits adultery on her husband, here in the Philippines, she, along with her lover, can, and will be put in jail if he catches her.

Woman, 51, her “lover” charged with adultery

Charges for adultery were filed against a 51-year-old woman and her 44-year-old lover yesterday before the Office of the Provincial Prosecutor after her husband caught them in the act of having sex inside a hut in Consolacion town last September 28.

Marcial Hidalgo, 58, a carpenter, and a resident of Consolacion, filed charges against his wife, Teresita, and her lover, Marlon Comiso, yesterday after the two were caught having sex inside the house of Comiso in the evening of September 28 in barangay Sacsac, Consolacion.

Marcial is the second husband of Teresita, with whom she has five children.

In his affidavit, Marcial said that he “had already known of the illicit affair of his wife with Comiso since February this year.” This was when he saw the two together in a videoke bar not far from their house, he said.

He also said that sometime in March, his wife left their house and lived with Comiso in sitio Manayataya, barangay Polog, Consolacion.

He said he even instructed his daughter to check on her mother, but his daughter came back with the news that the two had already left the said place.

Marcial added that he had already asked his wife to put an end to the affair for the sake of their children, but on September 28 he caught them in the act of having sex.

Prior to the incident, Marcial reported his concern to the Consolacion Police after learning that the two are living together in a house owned by a certain Boy Guaca in barangay Sacsac.

Police then went with Marcial to the said place where he saw his wife having sexual intercourse with Comiso inside the hut when he peeped through a hole on the wall.

I really believe that, had a woman caught her man in the same act, he would not have gone to jail. I'm not complaining, mind you, only making a statement.

I read about a similar case a few months back involving a man from the UK and a local woman. They had a child together and they were on the run from the authorities after the husband filed adultery charges. If memory serves, the husband was looking for a payment that the UK guy could not afford to pay.

This is a good warning to everyone getting involved with Filipinas to take things slow and be careful. The laws here are likely very different than what you are used to in your home country and many of the smiling faces around you are false.

Back home my list of basic requirements for a woman included a car and a job. Here, proof of age and a recently endorsed CENOMAR are good things to look for in a woman.

The only trouble here is, many times I have seen Filipinas with foreigners, either married or living in, who also had a Filipino boyfriend. What a Filipino boyfriend will do for them that another man can't, I have no idea. Of course, it may only be bragging rights, to have a foreigner boyfriend/husband and a Filipino at the same time. Either way, this lady was obviously not thinking of her family and future.

Rarely, if ever, now do people go to jail in the Philippines for adultery, although it is still against the law in the Philippines.

For a person (or persons) to be charged with this offence, a formal complaint must first be lodged before the police can act. Once caught and charged, the accused generally has two options-
  • Come to some arrangement with the complainant (pay money?) so that the claimant will withdraw the complain and the charges are then automatically dropped, or
  • Proceed through the court system that will take many months or years with the associated legal costs.
Option 2 normally only results in a fine (rarely incarceration).

Well, I have to disagree here. I have known of other cases where the woman was sent to jail, as well as her lover, after being caught.

In fact, my own former wife left Cebu, having moved to Manila, for similar reasons. Later, she had a baby by her lover. Had I chosen to, I could have caused all sorts of problems for both of them, prior to them leaving the country. But, I opted not to do that. After all, what good would have come out of it? Nothing, in my eyes. We split up and she didn't go with him until sometimes after we were separated. So, it wasn't like she cheated on me with him.

And yet the odd thing is that many Filipinos, expecially those in prominent positions, have lovers, often quite openly.

Marcos did, as one example.

Some even have many lovers, (which, I gather, shows their prowess!) boast about it in public, and yet it is taken for granted.
Indeed, it seems to be admired by many other Filipinos.

I would be interested to see the thoughts on this subject from some of the ladies here.

I probably should have been clearer here. By the term "go to jail" I meant sentenced to a term of incarceration by a court of law. When charged with adultery, the person(s) will invariable spend at least some time in police cells while things are sorted.

This seems really amazing given that so many Filipinos are walking around married but separated. There have been other threads here about ex-pats living with the GF who is technically still married because they never could afford the annulment. There's has to be some kind of balance to this.
