There can be many reasons, but even if one had got medical insurance, there is still the gap whilst waiting for the insurance company to pay out.

That requires some cash in hand, and I suspect many dont have the ready funds that could be required.

Somewhere else on this forum a fund is being discussed, helping members in medical emergency situations. While I think this is a good idea, the success of such really depends on how each one is willing to help others without thinking about himself.

Thank you for mentioning the Expats' Mutual Assistance fund that I'm trying to get off the ground. I'm about to provide an update as to how that's progressing - and the indications are good. Once it's established, it will be open to both donations and member subscriptions.

The lawyers gave the following advice: owing money is not a crime in the Philippines, it is a civil matter. But it is a civil offence to detain someone who is unable to pay their debt: that is false imprisonment.

Yes, Mark you are correct in saying what you just said. The Philippine Constitution under the Bill of Rights provides that "Section 20. No person shall be imprisoned for debt or non-payment of a poll tax." However, the hospital will ask the patient to execute a promissory note to guarantee the payment of his debts. In this case, should the patient default from payment; he will be charged in court for collection of money which is a civil case. If he uses a check to guarantee his release from the hospital and the check eventually bounced, he will then be charged criminally for violation of the “BP. 22 or the Anti-Bouncing Checks Law or Estafa” whichever is applicable. The possibility of being imprisoned for non-payment of debt is still there depending on how the collateral was secured.

There is special legislation specific to hospitals in this regard:

Hospital Detention Bill said:

REPUBLIC ACT NO. 9439
April 27, 2007 AN ACT PROHIBITING THE DETENTION OF PATIENTS IN HOSPITALS AND MEDICAL CLINICS ON GROUNDS OF NONPAYMENT OF HOSPITAL BILLS OR MEDLCAL EXPENSES

Be it enacted by the Senate and House of Representatives of the Philippines in Congress assembled:
SECTION 1. It shall be unlawful for any hospital or medical Clinic in the country to detain or to otherwise cause, directly or indirectly, the detention of patients who have fully or partially recovered or have been adequately attended to or who may have died, for reasons of nonpayment in part or in full of hospital bills or medical expenses.
SEC. 2. Patients who have fully or partially recovered and who already wish to leave the hospital or medical clinic but are financially incapable to settle, in part or in full, their hospitalization expenses, including professional fees and medicines, shall be allowed to leave the hospital or medical clinic, with a right to demand the issuance of the corresponding medical certificate and other pertinent papers required for the release of the patient from the hospital or medical clinic upon the execution of a promissory note covering the unpaid obligation. The promissory note shall be secured by either a mortgage or by a guarantee of a co-maker, who will be jointly and severally liable with the patient for the unpaid obligation. In the case of a deceased patient, the corresponding death certificate and other documents required for interment and other purposes shall be released to any of his surviving relatives requesting for the same: Provided, however, That patients who stayed in private rooms shall not be covered by this Act.
SEC. 3. Any officer or employee of the hospital or medical clinic responsible for releasing patients, who violates the provisions of this Act shall be punished by a fine of not less than Twenty thousand pesos (P20,000.00), but not more than Fifty thousand pesos (P50,000.00), or imprisonment of not less than one month, but not more than six months, or both such fine and imprisonment, at the discretion of the proper court.
SEC. 4. The Department of Health shall promulgate the necessary rules and regulations to carry out the provisions of this Act.
SEC. 5. If any provision of this Act is declared void and unconstitutional the remaining provisions hereof not affected thereby shall remain in full force and effect.
SEC. 6. All laws, decrees, orders, rules and regulations or part thereof inconsistent with this Act are hereby repealed or amended accordingly.
SEC.7. This Act shall take effect fifteen (15) days after its publication in two national newspapers of general circulation. Approved,

It should be noted that the hospital may have committed a criminal offence by detaining Mr Hunt when he was unable to pay his original bill some 3 months ago, provided he did not occupy a private room at that time. If he did indeed occupy a private room, there may still be redress in the civil court for false imprisonment.

Yes he did occupy a private room....by the way here my yesterday's update:

April 17, we didn't received any donations and looking at the improvement of Mr Hunt yesterday, I really could not afford even to think that there will also be no medicine for this day. So again, I borrowed another 9 thousand pesos for today's medicine. I don't know but I am going deeply in debt now but I put my trust to those who give their pledges...we are almost over in transferring him to a regular hospital room and we can't just simply give up at this point! I hope, we are all one on this stand!

Linda told me that she paid for the some laboratory tests with the 100 dollars sent by Janelaze the other day and also one ZENALB 20% Sol.

Hopefully Jane laze (Mrs Hunt) will be true to her word and will send money tomorrow for the medicine..Expats' Ladies charities will make sure that we can pay our loan first amounting to 13,600.00 with the money of Mr Dodge deducted already. And i also hope that with the new laboratory test result, his medicinal expenses daily will decrease!

Janelaze, I know there are so many doubts cast upon you but it is my prayer that tomorrow I could make an update that today's medicine is paid for by Mrs Hunt's initiative.

Regarding the latest picture of Mr Hunt, had you seen him 4 days before......this showed him in a lot better condition!

This thread unfortunately shows the great organization and efficiency, as well as the enormous amount of caring one can usually expect out of the Red Cross. As a former search and rescue worker, I have seen this type of operation countless times, in a country where they don't run on Filipino time and most emergency services are very efficient.

He had no child of his own. His step son is trying to help but not financially....he also can't act on his behalf because of the wife in the US seemed to be doing something also...and besides he had to have a power of attorney. His sisters are also on their 70's and living on social security....really don't know and the reason why I recorded everything online is for them to know that I don't get even a single centavo from the money that is being solicited for Mr Hunt!

According this ARTICLE, he is a friend of Mrs. Hunt who was quoted as saying "Something just doesn't seem right when a stranger does that out of the blue" in regards to the expat's wives assistance in the matter.

Markham is correct " we think " regarding Mr Dermott . B)

What matters of course is that the VA apparently has seen fit to get involved . Actually there were several people state side working on that . But given the fact it happened so quickly my guess is that one of the interested Senators made a call , perhaps Warner of Va . Anyway , it's all good . :rolleyes:

Yes its great news for Mr. Hunt. hope he gets well enough soon enough to make it back Stateside. Also hope that Daisy and the Expat wives club get full reimbursement.. It would also be nice if Mrs Hunt would send over funds to pay back money that was donated by those here that helped keep her husband alive. That way those that contributed might still be willing to help out next time someone else is in need.

Daisy and the other ladies from the CDO expat group have done a tremendous job. Not just in the face to face efforts with Tom and the the nonsense States side. Even more so Daisy and others have held their heads high whilst idlers just snapped at what was being done not to mention having their honesty called into question.

There has also been a lot of behind the scenes efforts being made by some of the CDO expat group members especially those who live in the States to bring pressure to bear.

This has been a collective effort with outstanding individual performance and contribution.

Daisy as I stated before I would trust you with far more than just money.

Daisy and the others its a privilege to know you.

However, today Mr. Hunt is fighting for his life....that's the saddest reality that we have to face. When we decided to buy the upgraded medication last night, it was accompanied with high hopes that his SS money will arrive tonight and that Linda could draw it in the ATM and buy his follow medicine, we can't aford anymore to keep on borowing and charge it to whoever will donate because even in paying to us is the last of our priority.
Yes, we received another 23K pesos today from Nancy, fiancee of CT Dunn but even that, we have used already to buy his medicine last night. Linda, Aurea and and I informed her with our plan. This morning. we again bought almost 6K antibiotics but tonight we could no longer "play around" the money I am holding because it will be used for the April 25 wedding of my cousin. Linda knew it and would not also dare to borrow the money even if I offered it to her tonight. In the end we get out from Mercury Drug, (this is the only store where his most important medicine is available) with empty hands except for the doctor's prescription! I didn't gp home yet......I am sad. Waiting for the text from Linda. If his money is there at 10 pm, she will buy the medicine he needs.

As I said before God will lead us to His perfect way.

Daisy I think I said somewhere else in this string you deserve some sort of reward for all the help you have given Mr. Hunt, but I'm starting to get worried now you are putting yourself seriously out of pocket now on what is starting to
look like a lost cause.

That may sound a hard view, but I was previously an unpaid volenteer welfare office for the Royal Air Forces Association and and dealt with many cases where RAF veterans were terminally ill, where we tried to get funding for special treatments
etc. to extend their life or make it more comfortable, I think the lesson from that was that you can only do so much
with the resources available, and sometimes those resources can be wasted if the person is unlikely to come out of it
with a good quality of life.

I don't know the facts, so I am asking the question is there actually a good chance Mr. Hunt will come out of this with a good
quality of life? Or by providing this medication at great personnal costs / efforts to yourself are we actually just prolonging
the inevitable, as if thats is the case I for one would say there should be no relection on you if there is a point where it
has to stop, you did the very best with the resources you had (and deserve a recognition of what you did).

The other thing that spring to mind here is that since I have known my gf (2 1/2 years) several of her Filipina friends have
died from things that in the UK would have been treatable by the free national health service, what shocked me and I had
a problem getting my head round was in those cases when they knew that friends and family could not afford the treatment
required and effectivly sacrificed themselves so as to save their family from financial ruin, and those were young people
with potentialy a full life ahead of them.

It seems Mr. Hunt chose to come to PI and yes his wife is no doubt the cause of alot of this situation (pity there is not a crime she can be charged with) effectivly his failing to spot what was going on is the main cause of the present situation, but in providing treatments that might not even give him a resulting good quality of life are we saying here that he is more deserving than alot of the young Filipina's with potentially full lives ahead of them that die because they cannot afford
treatment?

Some hard thaughts needed here and I know my thoughts might be controvercial, you are the one closest to the facts, but if you decide the treatment at the present for consumpion of cash is not viable and has to stop I would say you did the best you could and still deserve some sort of recognition for what you have done.

If I have read the situation wrong and there is actually a good chance of survival and a good quality of life I appologise
in advance if my direct views cause offence.

Hello everyone!

Daisy and Aurea here inside internet cafe near the Polymedic Hospital.

First, please try to contact VA again and advise us who is the person took for...We've been trying to contact this number 02-8384566 but on one will answer except for an answering machine and nobody calls the hospital....

Second, we woul like to inform everybody that Tommy is improving since last night. Yes, we are so hopelless at that time but Praise God somebody who also have a patient in ICU bought accidentally bought a medicine prescribed for Tommy and not to her own patient. The nurses gave to Tommy and they asked Linda that to replace it today. Today, his SS money arrived and we continue the medication in the total amount of 27,951 pesos which is until 6pm tomorrow.

As such his condition temporarily stablized. The doctors now recommend him for tracheostomy,and ETA BS/CS while it is still possible to administer it to him...We will partially pay his Tracheostomy and ETA whatever is left to his SS money which is 23K still in the bank. But the required amount for this medical procedure is 33,500pesos. The doctors said that we can't afford to wait until the VA is approve in Manila.

To all those who have been instrumental in helping Tommy Hunt to go this far...and to those who are hesitant but are still have the willingness to help...we will value evry penny you could share.

As I will be very busy tomorrow and Saturday, for the wedding of my cousin which the Expats' Ladies Charities, Inc organized as one of our fund raisng, I am asking everyone to please send it to:
